DISTANCE SALES AGREEMENT – CARPET PRODUCTS
Article 1 – Parties

(Hereinafter referred to as the “SELLER”)
1.2 Buyer
The real or legal person who places an order through the website rugsnarts.com.
(Hereinafter referred to as the “BUYER”)
Article 2 – Subject of the Agreement
2.1
The subject of this Agreement is the determination of the rights and obligations of the parties regarding the sale and delivery of standard-size carpet products ordered electronically by the BUYER through the website rugsnarts.com owned by the SELLER.
2.2
This Agreement has been prepared in accordance with:
• Consumer Protection Law No. 6502
• Regulation on Distance Contracts
• Law No. 6563 on the Regulation of Electronic Commerce
Article 3 – Definitions
Website: rugsnarts.com
Product: Standard-size, in-stock carpet products
Durable Data Storage: E-mail, order confirmation SMS, or similar permanent data storage tools
Article 4 – Formation of the Agreement
4.1
This Agreement shall be deemed concluded electronically upon the BUYER’s confirmation of the order and completion of payment.
4.2
The BUYER declares that, by confirming the order, they have read and accepted the Preliminary Information Form and this Agreement.
Article 5 – Product Information
5.1
Carpet products are not custom-made.
5.2
Product dimensions, weaving type, material and technical specifications are stated on the relevant product pages.
5.3
Product images are for representative purposes only. Minor color or tone differences arising from display screens, lighting or visual perception shall not be deemed a defect.
Article 6 – Price and Payment
6.1
The product price, inclusive of all applicable taxes, is clearly displayed on the order screen.
6.2
For shipments to the United States, customs duties and import costs shall be borne by the SELLER.
6.3
Payment may be made via credit card, debit card or other payment methods offered by the SELLER.
Article 7 – Delivery
7.1
Products shall be dispatched within a maximum of 30 (thirty) days from the order date.
7.2
The BUYER shall be responsible for any costs arising from incorrect delivery address information or failure to receive the shipment.
Article 8 – Delivery Inspection and Shipping Damages
The BUYER is obliged to inspect the product upon delivery. Products with damaged, torn, opened or impacted packaging must not be accepted without an official damage report prepared by the cargo officer. Responsibility for products accepted without such a report shall rest with the BUYER.
Article 9 – Responsibility for Depreciation in the Right of Withdrawal
In the event of exercising the right of withdrawal, the BUYER shall be responsible for any depreciation resulting from use or improper storage of the product. Products that lose their resale suitability are not eligible for withdrawal.
Article 10 – Right of Withdrawal (Carpet Products)
10.1
The BUYER has the right to withdraw from the contract within 14 (fourteen) days from the date of delivery without providing any justification.
10.2
For the withdrawal to be valid:
• The product must not have been used,
• Must not be stained,
• Must not be damaged,
• Must be in a resaleable condition.
10.3
The right of withdrawal cannot be exercised for products that have been used, cut, washed, damaged or improperly handled.
Article 11 – Exercise of the Right of Withdrawal
11.1
The BUYER must notify the SELLER of the withdrawal through a durable data storage method.
11.2
In the event of withdrawal, return shipping costs shall be borne by the BUYER unless otherwise stated on the website.
Article 12 – Method of Refund
Refunds shall be made using the same payment method used by the BUYER during the purchase. No additional fees, commissions or deductions shall be charged to the BUYER.
Article 13 – Refund Period
13.1
The SELLER shall refund the product price within 14 (fourteen) days from the date the returned product is received.
Article 14 – Force Majeure
Events such as natural disasters, war, epidemics and customs delays shall be considered force majeure.
Article 15 – Dispute Resolution
Consumer Arbitration Committees and Consumer Courts shall have jurisdiction.
Article 16 – Entry into Force
This Agreement shall enter into force upon electronic approval by the BUYER.
